User and Merchant Obligations
User Obligations
a) Users agree not to utilize the Free Flow Tech platform in any manner that violates laws or regulations, facilitates fraud, or exposes Free Flow Tech or its platform to legal risks or actions.
b) Users may only use bank account or card details provided through merchant systems strictly for completing transactions. Sharing or selling this data is prohibited unless the information was independently obtained.
c) Users must adhere to Free Flow Tech’s terms and conditions and are strictly prohibited from modifying, reverse-engineering, decompiling, or disassembling the platform without prior written approval.
d) Users are required to submit accurate personal and business information in accordance with Free Flow Tech’s Know Your Customer (KYC) protocols.
Merchant Obligations
a) Merchants must fully comply with all applicable laws, regulations, and industry standards when using the Free Flow Tech platform.
b) Merchants are prohibited from processing or depositing transactions on behalf of other businesses or entities.
c) Merchants must not accept payments from customers intended to refinance existing debt.
d) Merchants must follow Free Flow Tech’s guidelines for extracting data from payment instruments.
e) Merchants must provide customers with a valid transaction receipt—either digital or physical—clearly displaying the transaction amount.
f) Merchants are not permitted to impose additional surcharges, discounts, or finance charges for transactions involving payment instruments.
g) Merchants grant Free Flow Tech a non-exclusive, royalty-free license to use their trademarks and logos for promotional and marketing purposes.
h) Merchants authorize Free Flow Tech to reference their name in materials promoting Free Flow Tech services.
i) Merchants are required to implement Free Flow Tech’s specified security measures on their websites or mobile applications for payment acceptance.
j) Merchants must follow all written instructions provided by Free Flow Tech regarding the processing of electronic payments.
k) In the event of disputes, chargebacks, or fraudulent activity, Free Flow Tech reserves the right to refund the cardholder using the merchant’s available funds. If insufficient, Free Flow Tech may recover the amount through legal means.
l) Merchants must provide truthful and accurate information during business verification procedures. Falsification may result in penalties or account suspension.
Transaction & Settlement
a) Free Flow Tech will endeavor to process settlements to merchants within the agreed timeline. In cases of unavoidable delay, merchants will be promptly notified.
b) All submitted transaction data must reflect legitimate and compliant transactions as outlined in this agreement.
c) Merchants must maintain records of electronic transactions for a minimum of five (5) years from the authorization date.
General Obligations
a) Merchants must comply with all general rules and policies established by Free Flow Tech and its service providers.
b) Merchants are required to observe all relevant laws concerning the sale of goods and services through electronic transactions.
c) Merchants are solely responsible for fulfilling customer obligations regarding sold products or services.
Accepting Payments for Goods & Services
a) Merchants may accept payments only for products or services they directly sell to customers.
b) All payment processing and refunds must pertain to offerings that fall within the merchant’s declared business activities.
c) Merchants must inform Free Flow Tech in writing before altering their product or service offerings.
d) Merchants must provide Free Flow Tech with the website URL through which digital payments are accepted.
e) All customer-authorized transactions must be submitted to Free Flow Tech in compliance with relevant laws and this agreement.
f) Merchants must avoid actions or conduct that could harm the reputation of Free Flow Tech.
g) Merchants agree to indemnify Free Flow Tech against any claims or liabilities arising from their dealings with customers.
Disputes
a) Free Flow Tech will not participate in disputes between merchants and customers and must be held harmless from any related legal or financial consequences.
b) Merchants must not refuse returns or service cancellations based on the customer’s payment method.
Refunds & Chargebacks
a) For returns or cancelled services, merchants must electronically process refunds to the cardholder for the net amount after deducting applicable fees.
b) Merchants are required to retain all related transaction correspondence for at least five (5) years.
c) Free Flow Tech reserves the right to withhold merchant payments under circumstances including but not limited to unauthorized transactions, contract breaches, or failure to provide transaction details.
d) In the event of disputes or fraud, Free Flow Tech may refund the affected cardholder using the merchant’s available funds.
e) Each chargeback will incur a service fee, which will either be deducted from the merchant’s settlement or billed directly.
f) Free Flow Tech is not responsible for refunding charges related to subscriptions, setup fees, integrations, or security deposits.
Governing Law and Jurisdiction
This agreement is governed by the laws of Pakistan. Any disputes not resolved amicably will be subject to the exclusive jurisdiction of the courts in Pakistan, whose decisions shall be binding on all involved parties.
